Welcome to Mardita Records.
These Terms of Service explain the rules that apply when you visit, browse, use or place an order through Mardita Records.
Mardita Records is an independent UK-based online record store. Mardita Records is operated by Ross Ferguson, trading as Mardita Records.
In these Terms, “Mardita Records”, “we”, “us” and “our” refer to Ross Ferguson, trading as Mardita Records. “You” and “your” refer to the customer, visitor or user of our website and services.
Our online store is powered by Shopify, which provides the ecommerce platform that allows us to sell our products and services to you.
By using our website, placing an order, creating an account, contacting us or otherwise using our services, you agree to these Terms of Service, together with any policies referenced in these Terms, including our Privacy Policy, Shipping Policy and Returns & Refunds Policy.
If you do not agree to these Terms, you should not use our website or services.
1. About Mardita Records
Mardita Records is a UK-based online record store selling new and pre-owned vinyl records, CDs, cassettes and other music media.
At launch, Mardita Records is focusing mainly on new vinyl records. Other formats, pre-owned items, collectable editions and rare items may be added as available.
Mardita Records currently operates online only. We do not currently operate as a walk-in physical shop.

2. Use of Our Website
You may use our website for lawful personal shopping, browsing, account management, customer support and other normal e-commerce purposes.
You must not use our website:

To interfere with the security, performance or operation of our website.
To scrape, copy, reproduce or exploit our website content without permission.
To provide false, inaccurate or misleading information.
To impersonate another person or business.
To abuse, harass, threaten or harm Mardita Records, our customers, service providers or any other person.
We may suspend, restrict or terminate access to our website or services if we believe these Terms have been breached or if we need to protect our business, customers, website or service providers.
3. Accounts
You may be able to create an account on our website.
If you create an account, you are responsible for keeping your login details secure and for all activity under your account.
You must provide accurate, complete and up-to-date information when creating an account or placing an order.

4. Products and Product Information
We aim to describe all products clearly and accurately.
Product descriptions may include details such as artist, title, format, edition, colour, label, release date, condition, packaging, barcode, product images and other relevant information.
We make reasonable efforts to ensure product information, pricing, availability and images are accurate. However, errors may occasionally occur.
Product colours and appearance may vary slightly depending on your screen, device, lighting, display settings or product packaging variations.
Where a product is listed as new, sealed, coloured, signed, limited edition, pre-owned or otherwise special, we aim to make this clear on the product page.
For pre-owned items, condition details will be provided where applicable. Please remember that pre-owned vinyl records, CDs, cassettes and packaging may show signs of age, storage, handling or previous use.
We reserve the right to update product descriptions, pricing, images and availability at any time.
5. New, Sealed and Pre-Owned Music Media
New items are supplied as described on the product page.
If an item is described as sealed, it will be supplied sealed unless otherwise stated.
For sealed vinyl records, CDs, cassettes and other sealed music media, please check the product description before ordering. Packaging, hype stickers, inserts, colour variants, barcodes and edition details can vary between releases and suppliers.
For pre-owned items, we aim to inspect and describe the condition of the item fairly. Where applicable, pre-owned media may be cleaned, checked or play-tested before dispatch. However, some pre-owned items may be decades old, and playback can vary depending on the equipment used.
This does not affect your statutory rights if an item is faulty, damaged, not as described or not fit for purpose.
6. Orders
When you place an order through our website, you are making an offer to buy the selected product or products.
Your order is accepted when we confirm acceptance of your order and begin processing it for fulfilment.
We reserve the right to refuse, cancel or amend an order where necessary, including where:
A product is unavailable.
There has been a pricing, stock or product description error.
Payment cannot be processed.
Delivery details are incomplete or incorrect.
We suspect fraud, misuse or unlawful activity.
We are unable to fulfil the order for reasons outside our reasonable control.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.
Please check your order carefully before submitting it. If you notice an error after ordering, please contact us as soon as possible at info@marditarecords.com.
We can only amend order details, including delivery address, before the order has been dispatched.
7. Prices and Payment
All prices are shown in pounds sterling (£GBP), unless otherwise stated.
Prices may change at any time, but changes will not affect orders that have already been accepted, except where there has been an obvious pricing error.
Delivery charges will be shown before checkout and may vary depending on the delivery option selected and the order value.
Payment must be made using one of the payment methods available at checkout.
Payments are processed securely through Shopify and/or our payment providers. We do not directly store full payment card details on our own systems.
You confirm that any payment method used belongs to you or that you have permission to use it.
8. Delivery
We currently ship within the United Kingdom using Royal Mail, unless otherwise stated.
Delivery options, costs and estimated delivery times are explained in our Shipping Policy and shown at checkout where applicable.
Delivery times are estimates only and are not guaranteed. Postal delays, weather, public holidays, busy periods, supplier delays, release date changes, courier issues or other events outside our control may affect delivery times.
We are not able to guarantee delivery on a specific date or at a specific time unless this has been expressly agreed in writing.
Risk in the goods remains with Mardita Records until the goods are delivered to you or to a person nominated by you to receive them.
Once goods have been delivered to you or to a person nominated by you, responsibility for the goods passes to you.
If your order has not arrived within the expected timeframe, please contact us at info@marditarecords.com with your order number and delivery details.
9. Pre-Orders
Where pre-order items are available, this will be clearly shown on the product page.
Pre-order release dates and supplier delivery dates can change. We will aim to dispatch pre-orders in time for release where possible, but we cannot guarantee release-day delivery.
If there is a significant delay or issue with a pre-order, we will contact you where possible using the email address provided at checkout.
Pre-orders can usually be cancelled before dispatch. Once a pre-order has been dispatched, our standard Returns & Refunds Policy applies.
10. Cancellations, Returns and Refunds
Your cancellation, return and refund rights are explained in our Returns & Refunds Policy.
If you change your mind after ordering online, you usually have the right to cancel your order within 14 days of receiving your item.
Once you have told us that you want to cancel, you usually have a further 14 days to return the item to us.
For change-of-mind returns, items should be returned in the same condition they were received, with original packaging, inserts, sleeves and accessories included where applicable.
For new and sealed items, including sealed vinyl records, CDs, cassettes and other sealed music media, the item should usually remain sealed and unopened for a change-of-mind return.
If a sealed item has been opened, we may be unable to accept it as a change-of-mind return unless the item is faulty, damaged, incorrect, not as described, or you have another legal right to return it.
This does not affect your statutory rights.
If an item is faulty, damaged, incorrect, not as described or not fit for purpose, please contact us as soon as possible at info@marditarecords.com.
Approved refunds will be issued to the original payment method.
11. Customer Responsibilities
You are responsible for ensuring that the information you provide when placing an order is accurate and complete.
This includes your name, email address, phone number, billing address, delivery address and any order information.
If you provide incorrect delivery details and the order has already been dispatched, we may be unable to redirect the parcel or recover the item.
You are responsible for checking product details before placing an order, including format, edition, colour, condition, compatibility and any other product-specific information.
12. Offers, Discounts and Promotions
We may offer discounts, promotions, sale prices or special offers from time to time.
Promotions may be subject to separate terms, expiry dates, minimum spend requirements, exclusions or stock limits.
We reserve the right to amend, withdraw or cancel promotions where necessary, including where there has been an error or misuse.
Promotional prices may differ between our website, marketplaces, social platforms, physical events or third-party sales channels.
13. Errors, Inaccuracies and Availability
Occasionally, our website may contain errors, inaccuracies or omissions relating to product descriptions, images, pricing, offers, delivery charges, delivery times, stock availability or other information.
We reserve the right to correct errors, update information, amend availability, cancel orders or refuse orders where necessary.
If an error affects an order you have placed, we will contact you where possible using the details provided at checkout.
14. Intellectual Property
The content on our website, including text, branding, graphics, logos, images, design, layout, product descriptions, videos, audio, written content and other materials, belongs to Mardita Records or is used with permission from relevant rights holders, suppliers, platforms or licensors.
You may view and use our website for personal, non-commercial shopping and browsing purposes.
You must not copy, reproduce, distribute, modify, publish, exploit or use our website content for commercial purposes without our prior written permission.
All artist names, album titles, record labels, artwork, trademarks, logos and third-party content remain the property of their respective owners.
15. Reviews, Feedback and User Content
If you submit reviews, comments, feedback, messages, images, suggestions or other content to Mardita Records, you confirm that you have the right to provide that content and that it does not infringe the rights of others.
You agree that we may use, display, reproduce, edit or share feedback or reviews for the purposes of operating, improving and promoting Mardita Records, unless otherwise restricted by law.
You must not submit content that is false, misleading, abusive, unlawful, defamatory, obscene, threatening, offensive, spam, or harmful to our website, business, customers or any third party.
We may remove, moderate or refuse to publish user content at our discretion.
16. Third-Party Tools, Links and Services
Our website may include links to third-party websites, tools, apps, payment services, social media platforms or embedded services.
We are not responsible for third-party websites, services, content, privacy practices or terms.

17. Relationship with Shopify
Our store is powered by Shopify.
Shopify provides the ecommerce platform that enables us to operate our online store, process orders and provide related services.
Any purchase you make through our store is made directly with Mardita Records, not with Shopify.
Shopify is not responsible for the products sold by Mardita Records, our product descriptions, fulfilment, delivery, returns, refunds, customer service or any contract between you and Mardita Records.
18. Privacy
Your personal information is handled in accordance with our Privacy Policy.
Our Privacy Policy explains what personal information we collect, why we collect it, how we use it, who we share it with, how long we keep it and what rights you may have.
Because our store is powered by Shopify, Shopify may also process personal information as part of providing its e-commerce services.
Please read our Privacy Policy before using our website or placing an order.
19. Limitation of Liability
Nothing in these Terms limits or excludes liability where it would be unlawful to do so.
This includes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any rights you have under UK consumer law.
Subject to this, Mardita Records is not responsible for losses that were not reasonably foreseeable, losses caused by events outside our reasonable control, or business losses where products are purchased for personal consumer use.
We do not guarantee that our website will always be available, uninterrupted, secure or error-free.
20. Events Outside Our Control
We are not responsible for delays or failure to perform our obligations where this is caused by events outside our reasonable control.
This may include postal delays, courier disruption, supplier delays, strikes, industrial action, severe weather, fire, flood, pandemic, technical failures, payment provider issues, internet disruption, changes in law, government action or other circumstances beyond our control.
If an event outside our control affects your order, we will contact you where reasonably possible and take reasonable steps to reduce the impact.
21. Termination or Restriction of Access
We may suspend, restrict or terminate your access to our website or services if we believe you have breached these Terms, misused our website, provided false information, attempted fraud, or acted in a way that could harm Mardita Records, our customers, our website or our service providers.
Any sections of these Terms that are intended to continue after termination will continue to apply.

We may update these Terms of Service from time to time to reflect changes to our business, website, services, products, legal obligations, technology or policies.

When we update these Terms, we will update the “Last updated” date at the top of the page.
Your continued use of our website after changes are posted means you accept the updated Terms.

If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be treated as removed or limited to the minimum extent necessary.
The remaining parts of these Terms will continue to apply.
